This applies to all workers, including immigrant workers, regardless of whether they are documented.<\/p>\n\n\n\n<p>Under the Fair Labor Standards Act (FLSA), you are entitled to:<\/p>\n\n\n\n<ul>\n<li>The federal minimum wage (or Maryland\u2019s higher state minimum wage, if applicable)<\/li>\n\n\n\n<li>Overtime pay (1.5 times your regular wage) for hours worked beyond 40 in a week for non-exempt employees<\/li>\n\n\n\n<li>Timely payment for your work<\/li>\n<\/ul>\n\n\n\n<p>Employers cannot withhold wages because of your immigration status, and it is illegal for them to threaten to report you to immigration authorities to avoid paying you.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">You Have the Right to Be Protected from Workplace Discrimination<\/h3>\n\n\n\n<p>As an immigrant worker, you have the right to a workplace free from discrimination based on your race, national origin, or immigration status. The Equal Employment Opportunity Commission (EEOC) and the Department of Justice\u2019s Immigrant and Employee Rights Section (IER) enforce laws that protect workers from being unfairly treated.<\/p>\n\n\n\n<p>It\u2019s unlawful for an employer to:<\/p>\n\n\n\n<ul>\n<li>Refuse to hire or fire you based on your accent or country of origin<\/li>\n\n\n\n<li>Demand more documents than necessary for employment verification (also known as I-9 abuse)<\/li>\n\n\n\n<li>Retaliate against you for reporting discriminatory behavior<\/li>\n<\/ul>\n\n\n\n<p>Knowing your employment rights helps you recognize when you\u2019re being treated unfairly and know what steps you can take.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">You Have the Right to Report Unsafe Working Conditions<\/h3>\n\n\n\n<p>No one should have to risk their health and safety to earn a living. Federal law gives every immigrant worker the right to a safe workplace. The Occupational Safety and Health Administration (OSHA) protects workers by requiring employers to provide safe working conditions and necessary safety equipment. You do not need to be a U.S. citizen to report violations, and retaliation from your employer for doing so is illegal.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">What If You Are Undocumented?<\/h3>\n\n\n\n<p>Even if you are undocumented, you still have certain employment rights. Employers are not allowed to exploit your immigration status to violate labor laws. For instance, they still must:<\/p>\n\n\n\n<ul>\n<li>Pay you the minimum wage<\/li>\n\n\n\n<li>Follow safety regulations<\/li>\n\n\n\n<li>Comply with anti-discrimination laws<\/li>\n<\/ul>\n\n\n\n<p>However, there are still some challenges for undocumented workers.
