{"id":673,"date":"2023-11-20T11:15:44","date_gmt":"2023-11-20T19:15:44","guid":{"rendered":"https:\/\/www.elawrencelaw.com\/blog\/?p=673"},"modified":"2023-11-21T11:18:32","modified_gmt":"2023-11-21T19:18:32","slug":"student-visa-reinstatement","status":"publish","type":"post","link":"https:\/\/www.elawrencelaw.com\/blog\/student-visa-reinstatement\/","title":{"rendered":"Student Visa Reinstatement"},"content":{"rendered":"\n<p>As a F1 student on a student visa in the US, the student must always have a valid student visa during the duration of study. <\/p>\n\n\n\n<p>The student can apply for\nreinstatement if she\/he meet certain requirements such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Failed to maintain the terms of his or her immigration status; therefore, a DSO terminated the record as a result.<\/li><li>Will resume full-time study.<\/li><li>Can prove eligibility for reinstatement according to F-1 or M-1 regulations.<\/li><\/ul>\n\n\n\n<p><strong>Reinstatement Eligibility, Regulations and Policy Guidance<\/strong><\/p>\n\n\n\n<p>In general, to be\neligible for reinstatement, the student must:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Not be out of status for more than five months at the time of filing or show the exceptional circumstance that prevented filing in that time frame.<\/li><li>Not have a record of repeated or willful violations of regulations.<\/li><li>Not have worked without authorization.<\/li><li>Be pursuing or intend to pursue a full course of study in the immediate future at your school.<\/li><li>Not be deportable for any reason other than failing to maintain F-1 or M-1 status.<\/li><li>Be able to show that:<ul><li>Circumstances beyond the student\u2019s control caused the status violation.<\/li><li>Student fell below a full course load for a reason the DSO could have used to authorize a reduced course load, and the student would experience extreme hardship, if the student fails to get reinstatement.<\/li><\/ul><\/li><li>Regulations for Reinstatement can be found on F-1 reinstatement: 8 CFR 214.2(f)(16).<\/li><\/ul>\n\n\n\n<p>If you need reinstatement, please contact the Law Office of Elizabeth Anu\nLawrence, LLC. on 410.986.0088, 443.352.3201 or email us at <a href=\"mailto:infor@elawrencelaw.com\">infor@elawrencelaw.com<\/a> for legal help. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>As a F1 student on a student visa in the US, the student must always have a valid student visa during the duration of study.
