The purpose of the form is to help USCIS decide whether or\nnot the green card applicant is inadmissible based on their public charge\nstatus. If USCIS determines that the green card applicant is a public charge, a\nbond will be set. USCIS will inform the green card applicant that he or she has\nbeen deemed a public charge. Once that determination is made, the applicant\nmust file form I-945. <\/p>\n\n\n\n<!--more-->\n\n\n\n<p>It is important to complete Form I-944 to show that you and\nyour household members are more\nlikely than not at any time in the future to receive one or more public\nbenefits, for more than 12 months in the aggregate within any 36-month period. <\/p>\n\n\n\n<p>Your\nhousehold\u2019s annual gross income should be at least 125 percent (100 percent if\nyou are on active duty, other than in training, in the U.S. Armed Forces) of\nthe Federal Poverty Guidelines for the most recent year as set by the U.S.\nDepartment of Health and Human Services (HHS) for the household size. <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Exclusions<\/h3>\n\n\n\n<p>Certain applicants are excluded from form I-99, they are:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>A\nVAWA self-petitioner<\/li><li>A\nSpecial Immigrant Juvenile <\/li><li>A\nCertain Afghan or Iraqi national<\/li><li>An\nAsylee<\/li><li>A\nRefugee<\/li><li>A\nvictim of qualifying criminal activity (U Nonimmigrant) under INA section\n245(m)<\/li><li>An\napplicant for U visa who is seeking adjustment of status based only on the U\nvisa application<\/li><li>As\na victim of human trafficking (T nonimmigrant) under section 245(l) of the INA;\n9. Under any category other than INA section 245(l), but you either have a\npending application for T nonimmigrant status (Form I-914) that sets forth a\nprima facie case for eligibility, or are in valid T nonimmigrant status at the\ntime you file your application for adjustment of status. (This exemption only\napplies if your Form I-914 is still pending and deemed to be prima facie\neligible, or you are in valid T nonimmigrant status when we adjudicate your\nadjustment of status application)<\/li><li>Under\nthe Cuban Adjustment Act<\/li><li>Under\nthe Cuban Adjustment Act for Battered Spouses and Children<\/li><li>Based\non dependent status under the Haitian Refugee Immigrant Fairness Act<\/li><li>Based\non dependent status under the Haitian Refugee Immigrant Fairness Act for\nbattered spouses and children<\/li><li>As\na Lautenberg Parolee<\/li><li>Under\nthe Indochinese Parole Adjustment Act of 2000; 16. Based on continuous\nresidence in the United States since before January 1, 1972 (\u201cRegistry\u201d)<\/li><li>Under\nthe Amerasian Homecoming Act<\/li><li>As\na Polish or Hungarian Parolee<\/li><li>As\nNicaraguans and other Central Americans under section 203 of the Nicaraguan\nAdjustment and Central American Relief Act (NACARA) <\/li><li>As\nan American Indian Born in Canada (INA section 289) or the Texas Band of\nKickapoo Indians of the Kickapoo Tribe of Oklahoma, Pub.
